· From OJEU contract notice to contract award
GAR (UK) has many years experience in the structuring, conduct and management of tendering both in the Public and Private sectors. We now provide that service as a stand alone or as part of a wider brief.
· Scope and specification verification
Our service will discuss your requirements with programme board and operational staff to ensure accurate content with allowable flexibility, for entry into OJEU.
Where OJEU entry is not required, or in parallel with the contract notice period, we will facilitate the completion and verification of the specification (at high level in the event of Competitive Dialogue) and key performance indicators along with tender evaluation criteria and contract documentation.
We will facilitate the Supplier Pre Qualification Questionnaire process where appropriate.
· Resource planning and documentation preparation
Early planning and identification of leads and other key roles in the preparation for and the participation in, the tendering process through to contract award is paramount to an efficient and correct conclusion free from legal challenge.
The tendering process to be followed is dependant upon complexity of the project, completeness of knowledge to define EXACTLY what you want to by and/or achieve from the purchase, your ability to define the financial or the legal basis of the contract.
The most commonly used alternatives are:
- Competitive Negotiation
This procedure is relatively unrestricted following pre-qualification. It is quite usual for detailed negotiations to continue following final tenders & preferred bidder selection. The procedure is only used in very complex procurements and due to lack of structure, runs a risk of distorting competition.

This model is used where the technical means capable of satisfying the objectives or the legal or financial make-up of a project are unable to be objectively defined. It is an interactive and iterative process throughout dialogue based on collaborative development. The process concludes with a closed, competitive bidding procedure.
- Restricted
This model is a closed bid process which, following the issue of an Invitation to Tender to selected bidders, has restrictions on dialogue with the Bidders.
- Open
This model is an open invitation to any interested party to tender in accordance with the specification and contract documentation published. It excludes short listing and negotiations.
· The above procedures are set out in the EC Directive 2004/18/EC and in the UK Public Contracts Regulations SI 2006/5 (Scotland SSI 2006/1).
